Congress is now considering a new bill called The Carmelo Rodriguez Military Medical Accountability Act which would allow some members of the military to sue the government in cases of medical malpractice.
The bill is named after Marine sergeant Carmelo Rodriguez who died of skin cancer in 2007. In 1997, the military doctor failed to tell Rodriguez of a spot that he had on his right buttock. Later, the same spot was misdiagnosed by another doctor as a wart. Rodriguez, after serving a tour in Iraq and coming home, got a second opinion from a dermatologist. The dermatologist informed Rodriguez that the spot was stage-three skin cancer. Rodriguez died within the next two years from cancer.
The bill would hold the military accountable for cases of medical malpractice. The military right now is protected from many lawsuits with current policies from personnel.
