Congress Considering New Malpractice Bill

Congress is now considering a new bill called The Carmelo Rodriguez Military Medical Accountability Act which would allow some members of the military to sue the government in cases of medical malpractice.

The bill is named after Marine sergeant Carmelo Rodriguez who died of skin cancer in 2007.  In 1997,  the military doctor failed to tell Rodriguez of a spot that he had on his right buttock.  Later,  the same spot was misdiagnosed by another doctor as a wart.   Rodriguez, after serving a tour in Iraq and coming home, got a second opinion from a dermatologist.  The dermatologist informed Rodriguez that the spot was stage-three skin cancer.  Rodriguez died within the next two years from cancer.

The bill would hold the military accountable for cases of medical malpractice.  The military right now is protected from many lawsuits with current policies from personnel.

Woman Sues for Sponge Left in Her

A woman is suing a hospital and a physician after allegedly  leaving a surgical sponge inside the woman after a surgery.  The procedure was a c-section,  and it occurred at the hospital last year.

The couple has said that after the surgery,  a check of the surgical inventory showed that the sponge was missing.  The woman then reportedly had a lot of pain and discomfort in her mid section area around the abdomen.   With this not being explained easily,  a CT scan was conducted and the sponge was identified inside the woman. 

The lawsuit seeks costs for medical harm, suffering, and damages.

Jury Awards $11 Million in Death in Oral Surgery

A standard procedure to remove a patient's wisdom teeth were anything but standard. The death of a patient occurred in New Jersey while he was getting his wisdom teeth removed.

The patient had a genetic disorder that impacted his immune system.  The genetic disorder would cause facial swelling if the face was hit or bruised.  The patient was referred to the oral surgeon by his medical doctor.  The oral surgeon stated that the patient needed his wisdom teeth out and then was informed of his immune disorder.  

The proper procedure would have been to contact the patient's medical doctor to confirm if the surgery was safe or possible, but the oral surgeon failed to do so.  The wisdom teeth removal procedure took place.  The end result was that the patient was rushed to the hospital and put in emergency care,  but died later from his injuries.  

The jury decided that medical malpractice occurred and awarded the patients family $11 million dollars.
