Appeals Court Finds in Favor of Hospital

The US Court of Appeals for the Fifth Circuit has ruled in favor of Memorial Hermann Hospital System in Houston, Texas in a case involving a stroke victim. The judges ruled that there was not enough evidence to prove that different treatment could have lessened the victim's impairment.

The man suffered the stroke on March 29, 2003 and was taken to the emergency room at 9:20pm. The stroke was diagnosed around 2:30am the following morning. However, he did not receive a treatment that may or may not have saved him from the severe impairment from which he now suffers.

Doctors Fail to Inform Patients of Abnormal Test Results

A research team from Weill Cornell Medical College recently looked into the records of 19 primary care practices and 4 academic medical centers for failure to inform patients. The results from looking at 5,434 records were high.

Of 1,889 abnormal results found by the research team, 135 never reached the patients. That's over 7%. In two of the academic medical centers, the number of abnormal results unreported to patients was 23%. These patients may be put at great risk by this failure to inform.

VA Hospital Prostate Cancer Treatment

The Philadelphia VA recently had to notify 92 prostate cancer patients of problems with their treatment. The VA Hospital treate 116 of those patients between 2002 and 2008 with 92 improper treatments.

The patients underwent brachytherapy, a treatment that targets the prostate and minimizes radiation to healthy organs. Unfortunately, the process was done incorrectly and had the opposite results. Many of the veterans treated received too much radiation to their healthy organs and not enough to their prostates, causing serious problems.

23 years ago, Congress created a database of doctors who have had their privileges revoked for 31 days or more as a result of medical incompetence or malpractice. Unfortunately, the database is not working.

Hospitals do not face repercussions for failing to report doctors to the database. This allows doctors who have been negligent to continue working and possibly injure more people.

Man Injured by Several Medical Mistakes

In Texas, a man is suing the Medical Center of Southeast Texas in Port Arthur for several mistakes they made in his treatment. The man went to the hospital for severe stomach pains and is now unable to lift more than 15 pounds and is in need of surgery to fix those mistakes.

When the man first went in for treatment, he was misdiagnosed with pneumonia. Three days later, he was told that he would need to have surgery to fix two holes in his stomach. However, when doctors opened his abdominal cavity, they found no holes. On top of that, they failed to properly close the inscision.

Drug Reaction Spurs Texas Malpractice Case

In Chambers County, Texas, a woman is suing the doctors who treated her on May 23, 2007. The woman claims that she has a well documented allergy to sulfa drugs, but she was prescribed just that when she went in for treatment.

Her allergic reaction to the drug caused physical impairment and disfigurement and deteriorated her mental and physical conditions. Since using the drug she has lost the ability to earn money and has had piling medical bills.

Suit Alleges Needle Left in Body

In Texas, a man is filing a medical malpractice suit against his surgeon for leaving a needle in his body. The man underwent surgery on March 12, 2007 in Beaumont, TX.

The suit alleges that the surgeon did not retrieve a needle after it popped off an instrument into the man's body. The needle then perforated the man's bladder, causing him to urinate fecal matter.

Malpractice Suit Settled in West Virginia

A hospital in West Virginia has just settled a medical malpractice suit in which the family of a woman was suing for a surgery that occurred in 2005. The woman underwent a surgery to freeze a lesion on her kidney, but died soon after from complications.

During the surgery, the surgeon had punctured the woman's stomach, allowing the contents to seep out and cause a serious infection, leading to her death. The $2 million settlement came just before the trial, saving the hospital from having to admit to malpractice.
