Las Vegas Doctor Suffers Stroke, Will Face Malpractice Charges

Dr Dipak Desai suffered a stroke after his endoscopy clinics were connected to at least 9 Hepatitis C infections. This caused some concern about whether or not he would be able to defend himself in a trial.

A recent assessment of Dr Desai has shown that he is somewhat impaired, but will be able to stand trial. This will allow the patients who contracted Hepatitis C to bring their charges against him.

NJ Supreme Court Overturns $70M Award

In a medical malpractice case in New Jersey, a jury awarded a family $70 million. However, the New Jersey Supreme Court found that there were several flaws in the way the case was carried out and overturned the ruling.

The Supreme Court has ordered a new trial in the case of a 4 month old boy who received spina bifida surgery in 1998. The boy's oxygen tube was later dislodged, cutting off oxygen and causing permanent brain damage.

Medical Malpractice Numbers

There has been some outcry for caps on medical malpractice law suit caps. Some believe that putting caps on awards will help decrease health care costs in the country. However, numbers show differently.

Medical malpractice premiums account for less than 0.5% of the overall health care costs in the country. Medical malpractice claims make up only 0.2% of those costs. In addition, both premiums and claims have been in sharp decline over the last few years.

Doctors Allow Woman's Cancer to Spread

In Tennessee, a woman informed her doctor about a strange lump in her breast, but was not given a mammogram or any other diagnostic procedure. The woman returned to the doctor and was not diagnosed for a second time.

The lump got worse when the woman became pregnant, and the doctor's partner finally diagnosed her with breast cancer. In addition, the cancer was found to have spread to her liver. She then required a great deal of cancer treatment that precluded her from attending her own medical malpractice suit because she was so weak.

AZ Changes Emergency Room Malpractice Cases

Where once the burden of proof in medical malpractice lay with the defendant, it now lies with the plaintiff in emergency cases in Arizona. Governor Jan Brewer signed the legislation this week. It will take effect on September 30.

Jury Awards $10M in Medical Malpractice Case

In Texas, a jury has awarded a man $10 million after he had all his fingers, his right toes and his left leg amputated from just above the knee. The amputations were a result of gangrene acquired when he underwent several surgeries.

In 2002, the man had heart surgery to repair a malfunctioning valve. He then underwent another surgery to repair stitches and a third to implant an artificial valve. In each of the surgeries, he was administered a blood thinner which led to the gangrene.

Doctor Responsible for Malpractice from Oregon to Australia

Dr Jayant Patel worked in Portland, Oregon from 1989 to 2001 in which time he botched several surgeries and made many mistakes which led to the deaths of 4 patients. His employer attempted to restrict his negligence by keeping him from performing complex surgeries.

However, in 2002, Patel applied for and was hired to the Chief of Surgery position at Bundaberg Base Hospital in Australia. He did not tell them about his history of medical malpractice and has since been tied to 13 patient deaths. He is now facing charges of fraud and the manslaughter of 3 patients in Australia.

Malpractice Suit Too Late

In Wisconsin, a man underwent ulcer surgery in July of 2003 when doctors left a sponge in his body. He died from complications August 11 that same year. Unfortunately, his wife and estate did not file a malpractice/wrongful death suit until August 9, 2006.

According to the Wisconsin Supreme Court, the suit must be filed within 3 years of injury. This means that the family was only a few days too late in filing their suit, and will not be able to hold the responsible parties accountable.

Bill Publicizes NC Malpractice

A new bill has been passed in North Carolina that will publicize all medical malpractice awards over $75,000. The state's medical board originally attempted to publicize awards over $25,000, but compromised with the NC Medical Society.

The bill will allow the public to see which doctors have been found guilty of medical malpractice. Unfortunately, out of court settlements and awards of less than $75,000 will not be publicized.
