Baby Wins Malpractice Case

In 2005, a medical malpractice lawsuit was filed alleging that Cedars-Sinai Medical Center in Los Angeles, California failed to properly diagnose and treat meningitis in a baby.

On Friday, a Superior Court jury ruled in favor of the baby, now 5 years old, awarding $7.3 million in damages. The child, who now suffers from brain damage, will receive the award in a trust for past and future medical care.

$2M in Dental Malpractice Case

In May 2006, a woman went into dental surgery to have three teeth removed. However, the dentist mistakenly removed all 16 of her upper teeth during the surgery. Furthermore, the dentist altered the woman's records afterward to cover up the mistake.

Because of this, a jury recently awarded the woman $2 million in damages. The dental clinic, its CEO and three dentists all denied the allegations of malpractice, but were found to have injured the woman.

Family Wins Malpractice Case

In St Louis, a medical malpractice case ended with a jury awarding a family $6 million. The trial began on August 10 this year and the jury returned its verdict on Monday August 17.

On June 26, 2002, the family brought their 6 month old son to SSM Cardinal Glennon Children's Medical Center because he was feverish, lethargic and was having trouble breathing. The hospital discharged him, but he returned the next day. Six days later, the boy was pronounced dead at the hospital because a bacterial infection was not properly diagnosed.

Mistrial Ordered in Malpractice Case

The Montana Supreme Court has ordered a new trial in a medical malpractice case because of a mistrial. In October 2008, closing arguments were being given when a juror fell ill and had to be taken to the hospital.

Several people tended to the juror in the court room including the defendant. When the plaintiff moved for a mistrial, the judge denied it. However, the state Supreme Court ruled that a new trial was necessary for the case.

Surgeon Can No Longer Operate

As part of a medical malpractice settlement, a Nevada surgeon can no longer perform operations. Dr Lonnie Hammargren is accused of mishandling a 41 year old woman's brain tumor surgery in 2002.

A confidential agreement has been made by the Nevada State Board of Examiners that would still allow Dr Hammargren to retain his medical license. The allegations have yet to be proven.
