New Jersey Woman Loses Sight In One Eye, Settles Malpractice Case

A New Jersey woman recently received a $1.2 million dollar settlement with her opthamologist, following an accident that left her without vision in one eye. Sources say that the accident occurred during administration of routine anesthesia for cataract surgery. According to those familiar with the case, a misdirected anesthesia needle caused complications that resulted in the loss of sight in her eye.

The $1.2 million dollar settlement will be paid in part by the doctor's insurance and partly by the team responsible for administering the anesthesia.

Woman Files Suit Against Doctors for STD Misdiagnosis

A New Jersey woman has filed a lawsuit against a New York City hospital after she was wrongly diagnosed with HIV, herpes, and hepatitis following a routine mammogram checkup and STD test. She claims in the lawsuit that the misdiagnosis nearly ruined her marriage and caused herself and her family severe mental and emotional trauma.

The woman apparently was told that the "machine never lies", only to receive a call from the hospital nearly three weeks later saying that she was perfectly healthy.

Medical Malpractice Costs Exaggerated by Politicians

Many aspects of healthcare have been recently discussed and debated as a part of the massive healthcare reform debate which had been going on for several months.  One of the talking points of many politicians is that the cost of healthcare would be dramatically lower if medical malpractice suits did not exist.  This is a horrible notion and factually incorrect. 

Out of the total costs that go into healthcare in the United States,  only a small fraction of those costs can be attributed to medical malpractice.  Many of these costs are the result of lawsuits where a jury decides that a doctor or hospital were negligent and caused harm to another individual.  Many of these cases involve serious negligence by doctors or a hospital that resulted in serious injury, harm, or even death to an individual or loved one.  Reducing the ability to seek damages for cases medical malpractice would seriously reduce the quality of care in the United States,  further damaging the current healthcare system.

KY Jury Awards Couple $4.6M in Medical Malpractice Verdict

A jury in Pike County, Kentucky, returned a $4.6 millionverdict in a medical malpractice lawsuit on Monday evening.

The jury returned the verdict in Hackney Vs. Mark Swofford,MD shortly before 6:30 p.m. after three hours of deliberation. The verdict cameafter an eight-day trial in Pike Circuit Court, presided over by Judge StevenCombs.

Buddy and Geneva Hackney filed the malpractice lawsuitagainst Pikeville urologist Mark swoffered after an operation performed onHackney and subsequent treatment caused Hackney permanent injury.

Woman Suffers Knee Amputations Following Birthday Party, Sues Doctor

A Pittsburg woman who underwent below-knee amputations has filed a medical malpractice lawsuit against the treating physician.

20 year-old Shanna Hiles was celebrating her 20thbirthday on May 23. She consumed what her attorney describes as “an excess of alcohol.” According to court documents, Hiles lost conciousness while “seated on the floor with her legs tucked under her.” She stayed in that position for thefollowing twelve hours. She was taken to Uniontown hospital by a relative around 2:30 p.m. the next day.

Hiles alleges that she had signs of “acute compartment syndrome” a condition that is reversible by surgery if treated in time. The lawsuit contends that her treating physician waited up to six hours before transferring her to another facility, where she had bilateral knee amputations.

$22.3 Million Verdict in Medical Malpractice Case

A jury in Chicago awarded the parents of a ten year-old boya $22.3 million verdict in a medical malpractice lawsuit.

Jake Tinman was born at Advocate Christ Hospital on May 15,1999. He was born with a congenital heart defect which required a shunt. His parents,Michael and Pamela Tinman, were instructed to take the boy home. Two weekslater they returned to the hospital emergency room with Jake, where a series ofmedical mistakes led to the amputation of his left leg.

After a three week trial, the jury found in favor of theplaintiff. They found the doctors at Advocate Christ to have been negligent ofimproperly subjecting Jake to an unnecessary cardiac catheterization, improperlyapplying a pressure dressing to his leg and failing to remove the bandage in atimely fashion.
