Court orders state to return diverted funds to malpractice account

After $800 million dollars in surplus funds were diverted from an account designed to help doctors pay for malpractice insurance, a Commonwealth Court ordered the state of Pennsylvania to return the money to the “MCare” account. The diverted funds were to be used for other state expenses, but the court’s order may force the money to be returned to it’s original account. While some support the action, others believe that may cause an imbalance in the state budget.

Georgia man awarded $1.5 million in malpractice suit

A 47-year-old Georgia man was awarded $1.5 million this week in a medical malpractice suit following the loss of his thumb in a botched operation.

The suit was filed against several nurses and the Georgia hospital where they work. After an intravenous needle was incorrectly inserted into the man’s wrist, the flow of medication caused his hand to swell to painful proportions, the suit alleged.

Doctors were unable to reverse the damage and had to amputate the man’s thumb.

The settlement was awarded only four days after the striking down of a $350,000 cap on Georgia malpractice suit damages by the state supreme court. Had the cap been in place for the conclusion of the trial, the settlement would have been limited to a maximum of $400,000.

Malpractice suits drop in Pennsylvania

The number of medical malpractice suits in Pennsylvania continues to decline for the fifth straight year, reports show. There were 1,533 cases in 2009, compared with just over 1,600 in 2008. Pennsylvania saw a dramatic drop in medical malpractice suits after legislative changes in 2002 designed to reduce the large number of cases.

Before those changes, the number of medical malpractice lawsuits peaked at 2,900, and many doctors and hospital administrators worried that the state’s medical system might collapse from the rising costs. Current numbers have declined 44 percent from numbers gathered in 2000-2002. Philadelphia, seen as the center of the crisis, had a 59 percent drop during that time.

474 infected in Mass. hospitals in one year

In a study to reduce hospital infections, state public officials found that 474 people contracted infections while in a Massachusetts hospital last year.

The study found that 71 of the 73 hospitals in the state has infection rates at or below the national average between June 2008 and July 2009. The report only looked at two types of infections and did not say how many patients died due to the infections. An official from the hospital says that the issue of infections has been addressed and there has not been infections in months.

The U.S. Center of Disease Control and Prevention estimates that nearly 2 million people contract infections in hospitals every year.

Nursing home lawsuit alleges sexual abuse

A nursing home abuse lawsuit against Willowbrook nursing home has been filed. The lawsuit alleges that the nursing home failed to protect a resident from being sexually assaulted by another resident in May of 2009.

The lawsuit was filed by the victim’s mother and states that the victim was assaulted by a fellow resident. The lawsuit states the the nursing home is guilty of neglect for letting the patient stay into the home although there were objections from the staff. The man was admitted even though he had a history of propositioning people for sexual favors.

Baltimore Jury Awards $1.44M in Medical Malpractice Lawsuit

A jury in Baltimore County, Maryland has awarded $1.44 million to the family of a man who died after doctors failed to properly treat a case of sepsis.

According to court documents, the family of Thomas Murphy filed a lawsuit against St. Joseph Medical Center of Towson, and several doctors, after Murphy died of sepsis on June 11, 2007. The Baltimore County Circuit Court jury ruled that doctors at the hospital failed to provide proper care for Murphy. Doctors beleived Murphy had some kind of infection, but thought it was most likely pneumonia. Doctors administered a series of tests on Murphy, and he was given a broad spectrum antibiotic. Murphy was pronounced dead the next morning.

Sepsis is a severe inflammation that results from the body’s reaction to an infection, and can cause high heart rate, high respiratory rate, high body temperature, and an elevated white cell count. Sepsis causes organ damage and failure, severe cases result in death 20 to 35 percent of the time.

Maryland Couple Awarded $800K in Medical Malpractice Lawsuit

A surgeon in Los Angeles has been ordered to pay a Maryland patient and his wife $800,600 in a medical malpractice case.

According to court documents, Dr. Hrayr Shahinian performed an inappropriate surgery on George Ralli and then altered a pathology report to cover up his failure to remove a tumor. Shahinian admitted that he did not remove the tumor, but denies ever altering a document or trying to conceal the error.

Ralli and his wife traveled from Maryland to see Shahinian in 2006. A small, non-cancerous tumor behind Ralli’s left ear was threatening his hearing, and a childhood case of mumps had already destroyed the hearing in Ralli’s right ear. A judge said that Shahinian “was more interested in marketing then he was in medicine” when he sold the couple a minimally invasive procedure.

The $800,600 award included $300,000 for “intentional infliction of emotional distress.”
