$58M Verdict in CT Birth Injury Lawsuit

A family in Connecticut was awarded a $58 million verdict in a medical malpractice lawsuit on Wednesday.

According to court documents, a jury awarded 8 year-old Daniel D’Attilo and his parents $58 million in a birth injury lawsuit filed against the obstetrician who delivered him. The lawsuit claimed that Dr. Richard Viscarello failed to deliver Daniel early, despite complications. The lawsuit alleges that Daniel’s C-Section delivery was done improperly and deprived the newborn of oxygen.

The $58 million settlement includes $8 million for Daniel’s past and future medical bills, and $50 million for pain and suffering.

“The dollar amount means he will be taken care of, that’s what this means to us,” Cathy D’Attilo said.

Lawyers for Vicarello have vowed to appeal the verdict. They argue that Cathy received proper treatment and that Daniel’s disabilities are due to an infection that went undetected before birth.

The settlement is the largest in Connecticut state history.

Number of Pennsylvania Medical Malpractice Lawsuits Continues to Decline

The number of medical malpractice cases filed in Pennsylvania dropped in 2010.

According to a report released last week by the Administrative Office of Pennsylvania Courts, 1,491 medical malpractice suits were filed against doctors and hospitals in the state last year. The number of Pennsylvania medical malpractice lawsuits has declined every year since its peak in 2002, when 2,904 malpractice claims were filed.

Experts credit new medical malpractice regulations with the decline. One such rule requires plaintiffs to get another doctor in the same field to sign off on the claims, showing a lawsuit has merit. Another regulation requires claims to be filed in the county where the alleged malpractice took place, preventing lawyers from filing claims in counties where they believe juries will be more sympathetic.

$10.5M Verdict in CT Hospital Negligence Lawsuit

A Connecticut woman was awarded $10.5 million Thursday in a medical malpractice lawsuit.

According to court documents, 44 year-old Karla Rosa brought the medical malpractice lawsuit against Anesthesia Associates of New London over treatment she received at Lawrence & Memorial Hospital in 2006. The lawsuit claimed Rosa suffered “serious, severe, painful, and permanent injuries,” as a result of the “carelessness and negligence” of Anesthesia Associates.

According to the lawsuit, Rosa spent 26 days in a coma after her visit to Lawrence & Memorial. She sustained nerve damage and memory loss. She had to use a feeding tube and venous catheter for 45 days.

Sean McElligott, Rosa’s attorney, said he was glad to “finally be able to bring some peace to the family.” Rosa filed the lawsuit in 2008.

$7 Million Settlement in Medical Malpractice, Birth Injury Lawsuit

A judge in Massachusetts has approved a $7 million settlement in a medical malpractice birth injury lawsuit.

According to court documents, the lawsuit was filed in 2008 by a Shrewsbury family who accused hospital staff of negligence in the birth of their daughter. The lawsuit was filed against two doctors, a nurse practitioner, and a genetic counselor.

The lawsuit contends that Ran Zhuang and her husband, Zhiru Guo, were not provided with proper prenatal genetic counseling before giving birth to their daughter on November 11, 2007 at University of Massachusetts Memorial Medical Center. Their daughter was born with a rare genetic disorder known as cri-du-chat syndrome.

The Zhuang’s attorney said the child’s chromosomal abnormality could have been detected early enough to allow Zhuang to make an informed decision whether to terminate her pregnancy.
The defendants denied any negligence.

$13.9M Verdict in Ohio Birth Injury Medical Malpractice Lawsuit

An Ohio jury has returned a $13.9 million verdict in a birth injury lawsuit.

According to court documents, the jury found a doctor liable for medical negligence that resulted in a girl, now 10 years-old, developing cerebral palsy. The jury returned the verdict after less than two days of deliberations.

According to the lawsuit, a non-stress test during the mother’s pregnancy showed the baby’s heart rate to be low. The doctor suggested inducing labor, opting for an emergency Cesarean section. After inducing labor, however, the doctor decided not to perform the Cesarean section. The plaintiffs argued that this decision deprived the child of oxygen, resulting in cerebral palsy. The lawsuit alleged that a Cesarean section would have prevented the birth injury.

$9 Million Verdict in NM Medical Malpractice, Incorrect Diagnosis Lawsuit

A jury in New Mexico has returned a $9 million verdict in a medical malpractice lawsuit.

According to San Miguel County Circuit Court documents, Bryanna Baker will receive $1.8 million of the $9 million verdict, due to the state’s malpractice caps.

Baker filed the medical malpractice lawsuit against three physicians: Misbah Zmily, Lee Caruana, and Stephanie Hedstrom. The lawsuit claims the three doctors failed to diagnose the 24 year-old Baker’s heart attack, and ignored her obvious symptoms because of her age. Baker’s attorney, Randi McGinn, accused Zmily of abandoning Baker to see other patients who were not as ill.

Attorneys for the defense claimed Baker arrived at the emergency room with multiple symptoms and not just the “crushing chest pain” claimed by the plaintiff.

New Mexico’s malpractice law places a $600,000 cap on each doctor. McGinn said she plans to challenge the cap’s constitutionality.

$115K Verdict in N.J. Surgical Errors Medical Malpractice Lawsuit

A jury in New Jersey awarded a woman $115,000 in a medical malpractice lawsuit Wednesday.

According to Bloomingdale court documents, jurors found that Dr. Paul parker deviated from the accepted standard of care in performing cosmetic surgery on Marilyn Leisz. Leisz went to Parker for surgery to correct droopiness in her eyelids, a procedure called blepharoplasty.

The jury rejected Leisz’s other civil allegation that she was not fully advised as to the risk of incomplete eye closure as a possible consequence of the surgery.

The surgical errors lawsuit claimed that so much skin had been removed from Leisz’s eyelids during two previous surgeries that there was no excess skin to remove, and Parker never should have performed the procedure.

Medical Malpractice Lawsuit Filed Over Incorrect Dosage of Blood Thinner

A medical malpractice lawsuit has been filed against a Massachusetts hospital that admitted giving a woman a lethal dose of blood thinner.

According to court documents, the lawsuit was filed last month by the family of Geraldine Oswald, who died from a Lepirudin overdose at Massachusetts General Hospital in November 2010. The hospital has admitted that a mistake led to the 76 year-old woman receiving 30 times the recommended dosage of blood thinner.

The complaint was filed in Suffolk Superior Court on March 10. The lawsuit alleges Oswald went to the hospital to treat an infection. A nurse entered the wrong dosage into an automated IV, causing the drug overdose. Oswald bled internally for over 12 hours before dying.

The Oswald family says the lawsuit’s intent is to force changes that guarantee similar mistakes will not be repeated.

Hospital Negligence Lawsuit Filed Against Chicago Hospital Over Infant’s Death

A Chicago couple has filed a medical-malpractice lawsuit against a Park Ridge hospital claiming hospital staff negligently gave their 6-week-old son an overdose of sodium.

According to Cook County Circuit Court documents, Genesis Burkett died October 15, one month and nine days after he was born prematurely at Advocate Lutheran General Hospital. The lawsuit says Genesis was making good progress at the hospital until a pharmacy technician incorrectly filled a doctor’s order for IV fluid. Hospital staff allegedly gave the newborn an intravenous bag containing “approximately 60 times the dose of sodium ordered by the physician.”

The bag was labeled correctly, indicating the high level of sodium it contained, but at some point before a nurse administered it, a second label was placed over the first, said attorney Patrick Salvi, who represents the Burketts. The second label showed the correct amount of sodium that the doctor had ordered, Salvi said.

“Genesis Burkett should be a happy and healthy 6-month-old boy at home with his family today,” Salvi said. “The innocent infant died of malpractice, plain and simple. And we intend on proving it in court.”

Physician Named in Medical Malpractice Lawsuit Withdraws Appeal

A physician named in a medical malpractice lawsuit, which claimed he failed to diagnose a young boy’s brain condition, has withdrawn his appeal of a lower court’s decision not to reject the plaintiff’s medical expert report.

According to court documents, Ty and County Cropper filed a lawsuit on April 20, 2010 in Jefferson County District Court against Dr. Edward Braye Jr. and Regional Pediatrics, alleging Bray failed to diagnose their son’s hydrocephalus, also known as water on the brain, causing him to experience severe developmental problems. Braye and Regional Pediatrics filed an accelerated appeal in January, claiming the plaintiffs’ medical expert report was did not comply with Texas Civil Code.

The Ninth Court of Appeals of Texas issued a memorandum opinion on March 24 stating that the appeal had been dismissed at the defendants request. “Braye and Regional Pediatrics filed a motion to dismiss this accelerated appeal,” the opinion says. “The motion is voluntarily made by the appellants prior to any decision of this Court. No other party filed notice of appeal. We grant the motion and dismiss the appeal.”

The Croppers’ lawsuit states Braye failed to recognized their son’s abnormal had circumference growth, and “as a result, the evidence will show that Dr. Braye failed to timely diagnose hydrocephalus resulting in a delay in definitive treatment and a prolonged period of intercranial pressure during a critical period of rapid brain development such that Breylon Cropper now has severe developmental deficits.”
