St. Joseph’s Hawks Women’s Tennis Open at Navy this weekend

Pennsylvania medical malpractice attorneys of Lowenthal & Abrams, P.C. are excited to announce the St. Joseph’s University Women’s Tennis Open this Saturday against Navy in Annapolis, MD.

Ian Crookenden leads the Hawks for the fourth year in a row with a roster of new and veteran players.  The Hawks received an Atlantic 10 preseason prediction of 11th place, but Crookenden and his players are ready to prove them wrong.

Junior Casey Robinson is back after a fantastic 2010-2011 season where she earned No. 1 singles player Atlantic 10 All-Conference Second Team honors.

Sixers holiday event for Iraqi veterans

The Philadelphia 76ers are welcoming home Iraqi veterans and their families to the Toys for Tots “Home for the Holidays” at The Shops at Liberty Place.  Those who bring a new, unwrapped toy will get access to the “autograph” room with Sixers and their coaches and a ticket voucher for the first game of the season on Jan 6.

Ventilator warning errors associated with 119 deaths

Since 2005, over one hundred people reliant on ventilator machines to breathe have died due to caregivers failing to respond to warning alarms.

According to the Boston Globe, 119 deaths have occurred between 2005 and May 2011 relating to warning alarms. The U.S. Food and Drug Administration is highly concerned about this problem and issued a warning to caregivers in hospitals, nursing facilities, and patients’ homes that ventilator alarms are going unheard.

Alarm fatigue, a condition related to nurses becoming desensitized to beeps and alarms after hearing them all day, has become a serious issue among hospitals.

Narberth Dickens Festival this weekend

The annual Narberth Dickens Festival is one of the most celebrated holiday traditions in the Philadelphia area.  Downtown Narberth is transformed into 1840′s London complete with characters from “A Christmas Carol” roaming the streets in full costume.  There is also a scavenger hunt for the kids to win a prize.  At 11am, a free screening of “A Muppet Christmas Carol” will be held.

Construction worker helicoptered to Allendale hospital

A 43 year old construction worker of Nazareth, PA fell 15 feet off a ladder while installing sprinklers and was flown to a nearby hospital in Allendale.

The man fell onto concrete resulting in injuries to his back and head. Fortunately, neither injury was life threatening. The incident occurred on Whitney Lane near Chestnut Street while the man was working a new townhouse.

He was rushed to Hackensack University Medical Center.

$2M Verdict in MA Medical Malpractice Lawsuit

A jury has awarded a Massachusetts couple nearly $2 million in a medical malpractice lawsuit they brought against a hospital.

According to court documents, Laura Ginisi claimed that doctors at St. Vincent Hospital in Worcester, Massachusetts, misdiagnosed several strokes her husband Joseph Ginisi suffered in 2004. The lawsuit also contends that a delay in treatment for cancer at the hospital led him to become legally blind and unable to walk.

The jury did not find any doctors or staff members negligent in their verdict, just the hospital. Hospital officials would not comment on the case, but noted Ginisi’s treatment occurred under previous ownership.

Laura Ginisi said she is pleased with the jury’s decision, but added that no amount of money will cure her husband, who is unable to live at home.

$20M Verdict in Pennsylvania Medical Malpractice Lawsuit

An appeals court has upheld a $20 million verdict in a Pennsylvania medical malpractice lawsuit.

According to Pennsylvania Superior Court documents, 18 year-old Amy Fledderman died as a result of complications from a lipsuction operation in 2001. The Fledderman family filed a medical malpractice lawsuit against Dr. Richard P. Glunk and a nurse, Edward J. DeStefano. The Superior Court panel of judges upheld the Philadelphia Court of Common Pleas $20 million verdict.

The appeals court also affirmed a $2 million emotional distress award for Fledderman’s mother, who was forced to wait for more than two hours while Glunk allegedly refused to send her daughter to the hospital. The judges also rejected the defendants’ argument that the $15 million in punitive damages was excessive.

Study Finds No Progress in Safety at Hospitals

Hospital safety has not improved in the last decade, according to a new report.

A study conducted from 2002 to 2007 in 10 North Carolina hospitals found that harm to patients was common and the number of incidents did not decrease over time. Published Thursday in The New England Journal of Medicine, the study is the first large report on hospital safety in a decade.

The study is viewed as the most rigorous since a landmark report in 1999. That report, by the Institute of Medicine, found that medical mistakes caused as many as 98,000 deaths and more than one million injuries a year in the United States. The Institute of Medicine led a national movement to reduce errors and make hospital stays less hazardous after the study’s publication.

AR Court Overturns Verdict in Suit Over Sponge Left in Patient

The Arkansas Court of Appeals has overturned a jury verdict in a medical malpractice lawsuit filed against a doctor who left a sponge inside a man after an operation.

According to court documents, Alan Sargent sued Dr. Marc Rogers in Garland County after Rogers operated and found a sponge he left inside Sargent during a gall bladder operation two years before. A trial was held to determine damages, after Circuit Court Judge John S. Patterson partially ruled in favor of Sargent. The jury awarded Sargent $100,000.

The Arkansas Court of Appeals, upon reviewing the suit, found that the jury should answer the question of whether leaving a sponge inside a patient constitutes a “deviance in the standard of care.”

The Appeals Court sent the case back to Garland County, Arkansas for a new trial.

Study: Admitting Errors Doesn't Increase Medical Malpractice Lawsuits

A new study indicates that when doctors admit medical mistakes, patients do not file more lawsuits.

According to researchers who examined the University of Michigan Health System, the system’s program of admitting all doctor and hospital mistakes, apologizing, and offering compensation does not lead to an increase in lawsuits. Dr. Allen Kachalia, lead author of the study from Brigham and Women’s Hospital in Boston, said a code requiring doctors to talk with patients when something goes wrong “allows doctors to be more open about their mistakes.” He added, “it can help foster trust in the physician patient relationship.”

In 2001 UMHS started a program of admitting all mistakes, and Kachalia compared the number and cost of claims against the hospital, before and after the new program was put in place. The total number of claims against the hospital decreased by almost 50 percent after full disclosure took effect.
